1) Sabihin nilang hindi sila tagapagmana ng yaman ng assets ni Ferdinand Sr.;
No. 120880).
"Tax is imposed on the income and things, without regard as to how it is acquired, especially for income taxation, estate taxation, and excise taxes imposed on goods. Whether it was legally or illegally obtained is of no consequence. As long as you earned the income, owned the property, or are in possession of the property (however obtained, legally or illegally), you are liable for the taxes imposed under the Tax Code. Ill-gotten wealth is not included in the estate, because at the time of the death of the former President Marcos Sr., it was already sequestered by the Philippine government, and he no longer owns it, and therefore no longer part of his estate. But if the ill-gotten wealth was not sequestered or forfeited to the government, the said asset, though ill-gotten, will still be included in his estate, and be subject to estate tax. To illustrate…A person was able to title a land by swindling someone (ill-gotten), but at the time of his death, it remains in his name, and no case was filed against him. The said land will be part of his estate and estate tax will be due thereon."
